General Terms and Conditions and License Terms for the software “NoicePatch” by Viktor Stark, starks.design, Reinhartserstraße 18A, 87437 Kempten, Germany (the “Provider”). As of October 2026.
1. Scope and subject of the contract
These terms apply to the purchase and use of the macOS software NoicePatch, including the supplied audio driver and the Stream Deck plugin. The purchase is made through the shop on starks.design; the customer information published there applies to the ordering process in addition.
2. Scope of the license
With the purchase, the customer receives a simple, perpetual right to use the purchased major version (version 1.x) on up to two Macs in the customer's own household or business. Activations can be managed in the customer account and moved to other devices. Passing on, renting out or publicly providing the license is not permitted.
The software must not be reverse engineered, decompiled or disassembled. This does not affect the mandatory statutory rights of the user, in particular observing, studying and testing the functioning of the program to determine the ideas and principles underlying it (Section 69d (3) German Copyright Act, UrhG), making a backup copy (Section 69d (2) UrhG) and decompilation or disassembly to achieve interoperability with an independently created program under the conditions of Section 69e UrhG.
3. Free trial
NoicePatch can be tried free of charge before purchase. The trial covers the full feature set for 7 days from the start of the trial. The trial starts by itself the first time the app is opened, without an email address, and is tied to that Mac; one trial per Mac at most. If the app cannot reach the license server on first launch, the trial starts the next time the app opens with a connection. If the automatic start fails, the trial can instead be requested in the app with an email address; the trial key is then sent to that address. Without a running trial and without an activated license, in particular after the trial period has ended, an audible noise is mixed into the output signal until a license is activated; the app otherwise remains usable, and configuration and settings are kept. The app points out the end of the trial before it expires. Setting the system clock back ends the trial period early. The trial is there for trying the app out and does not establish a claim to any particular feature.
4. System component (audio driver)
To provide virtual audio devices (up to 16 channels per device),
NoicePatch installs an audio driver into the system directory
/Library/Audio/Plug-Ins/HAL. The installation requires
confirmation with administrator rights and briefly restarts the system's
audio service. The driver processes audio locally only and can be removed
completely at any time from within the app (Settings → Remove driver, or
Help → Uninstall NoicePatch).
5. Third-party components
NoicePatch contains third-party software components under their own licenses. These licenses are not affected by the present terms.
- Airwindows (© 2018 Chris Johnson, MIT license) — signal processing of several sound filters.
- Sparkle (MIT license) — the built-in update function.
- The audio driver is based on the sample driver NullAudio from Apple's developer documentation (“Creating an Audio Server Driver Plug-in”).
The full license texts ship with the software and are available on request from [email protected].
6. Updates
All updates within the purchased major version (1.x) are included in the purchase price and are delivered through the built-in update function. Future major versions (e.g. 2.0) may be offered as a paid upgrade; purchases made shortly before a new major version is released receive a free upgrade period.
7. Right of withdrawal for consumers
Consumers have the statutory right of withdrawal. For digital content, the right of withdrawal expires once the Provider has begun performing the contract after the consumer has expressly consented and confirmed their knowledge that the right of withdrawal is thereby lost (Section 356 (5) German Civil Code, BGB). Details and the withdrawal notice are provided during the ordering process on starks.design.
8. Warranty and liability
Statutory warranty law applies. The Provider is liable without limitation for intent and gross negligence as well as for injury to life, body or health. For simple negligence, the Provider is liable only for the breach of essential contractual obligations, limited to the foreseeable damage typical for this type of contract.
9. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the mandatory protective provisions of their country of residence.
As of October 2026 — draft; the final version appears with the shop launch on starks.design.
